Terms of service

These Terms of Use (hereinafter referred to as “these Terms”) govern the terms and conditions for using the online shop (hereinafter referred to as “the Service”) provided by Samurai Art Shop Kazuno (hereinafter referred to as “the Shop”) on this website. All registered users (hereinafter referred to as “Users”) are required to use the Service in accordance with these Terms.

Article 1 (Application)

These Terms apply to all relationships between Users and the Shop regarding the use of the Service.

The Shop may establish additional rules, regulations, or other provisions (hereinafter referred to as “Individual Provisions”) regarding the Service. Regardless of their name, such Individual Provisions shall constitute a part of these Terms.

In the event of any conflict between the provisions of these Terms and the provisions of the Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.

Article 2 (Registration)

In order to use the Service, a registration applicant must agree to these Terms and apply for registration in the manner specified by the Shop. Registration shall be deemed complete upon the Shop's notification of approval to the registration applicant.

The Shop may refuse to approve a registration application if it determines that any of the following circumstances apply, and shall not be obligated to disclose the reasons for such refusal.

The applicant has provided false information in the registration application.

The applicant has previously violated these Terms of Use.

Other circumstances where the Shop deems registration inappropriate.

Article 3 (Management of User ID and Password)

Users shall manage their User ID and password for this service at their own risk.

Users shall not transfer, lend, or share their User ID and password with any third party under any circumstances. The Shop shall deem the use of the User ID and password combination to be by the registered user themselves if the combination matches the registered information.

The Shop shall not be liable for any damages arising from the use of the User ID and password by a third party, except in cases of intentional or gross negligence on the part of the Shop.

Article 4 (Sales Contract)

A sales contract shall be deemed to have been concluded when a user makes a purchase request to this shop and this shop notifies the user of its acceptance of such request. Ownership of the product shall transfer to the user when this shop delivers the product to the shipping company.

This shop may terminate the sales contract set forth in the preceding paragraph without prior notice to the user if the user falls under any of the following circumstances:

If the user violates these Terms and Conditions

If delivery of the product cannot be completed due to an unknown delivery address or prolonged absence

If the Shop determines that the trust relationship between the Shop and the user has been damaged

Regarding payment methods, delivery methods, cancellation of purchase requests, or return methods related to this Service, the methods specified separately by the Shop shall apply.


Article 5 (Intellectual Property Rights)

The copyright and other intellectual property rights to product photos and other content provided through this service (hereinafter referred to as “Content”) belong to this shop and the legitimate rights holders, such as the content providers, and users may not reproduce, reprint, modify, or otherwise use such Content without permission.

Article 6 (Prohibited Acts)

Users shall not engage in the following acts when using this service.

Acts that violate laws, regulations, or public order and morality

Acts related to criminal activities

Acts that infringe upon copyrights, trademark rights, or other intellectual property rights contained in this Service

Acts that destroy or interfere with the functions of this shop's servers or networks

Acts that commercially utilize information obtained through this Service

Acts that may interfere with the operation of this shop's services

Acts of unauthorized access or attempts thereof

Acts of collecting or accumulating personal information of other users

Impersonating other users

Providing direct or indirect benefits to antisocial forces in connection with this shop's services

Other acts deemed inappropriate by this shop

Article 7 (Suspension of Service Provision)

This shop may suspend or interrupt the provision of all or part of this service without prior notice to users if it determines that any of the following circumstances apply.

When the provision of this service becomes difficult due to force majeure such as earthquakes, lightning strikes, fires, power outages, or other natural disasters

The Shop shall not be liable for any damages incurred by the user as a result of actions taken by the Shop pursuant to this Article.

Article 9 (Withdrawal)

Users may withdraw from the Service by following the prescribed withdrawal procedures.

Article 10 (Disclaimer of Warranties and Liability)

The Shop does not guarantee that the Service is free from any factual or legal defects (including defects related to safety, reliability, accuracy, completeness, validity, suitability for specific purposes, security, etc., as well as errors, bugs, or infringements of rights).

The Shop shall not be liable for any damages incurred by the user as a result of the Service. However, if the contract between the Shop and the user regarding the Service (including these Terms of Use)is deemed to be a consumer contract under the Consumer Contract Act, this disclaimer shall not apply. However, even in such cases, the Shop shall not be liable for any damages incurred by the user due to the Shop's negligence (excluding gross negligence) resulting from breach of contract or tort, including damages arising from special circumstances (including cases where the Shop or the user foresaw or could have foreseen the occurrence of such damages).

The Shop shall not be liable for any transactions, communications, or disputes arising between users or between users and third parties in connection with the Service.

Article 11 (Changes to the Service)

The Shop may, without prior notice to users, change the content of the Service or suspend the provision of the Service, and shall not be liable for any damages incurred by users as a result thereof.

Article 12 (Amendments to the Terms of Use)

The Shop may amend these Terms of Use at any time without prior notice to users if deemed necessary. Notwithstanding the foregoing, users shall be deemed to have agreed to the amended Terms of Use upon commencing use of the Service following such amendment.

Article 13 (Handling of Personal Information)

The Shop shall handle personal information obtained through the use of the Service in accordance with the Shop's “Privacy Policy.”

Article 14 (Notices or Communications)

Notices or communications between users and this shop shall be made in the manner specified by this shop. This shop shall deem the contact information currently registered as valid and shall send notices or communications to such contact information, which shall be deemed to have been received by the user at the time of dispatch, unless the user notifies this shop of a change in such contact information in the manner separately specified by this shop.

Article 15 (Prohibition of Assignment of Rights and Obligations)

The user may not assign or pledge the status under the User Agreement or any rights or obligations arising from this Agreement to a third party without the prior written consent of the Shop.

Article 16 (Copyright Protection)

All images, illustrations, text, logos, designs, and other content posted on this shop are the copyright of “SAMURAI ART SHOP KAZNO” or the third party that holds the legitimate rights, and are protected by copyright law.

Reproduction, republication, modification, sale, or secondary use of this content without permission is strictly prohibited.

However, content explicitly marked as “downloadable” on this website may be used within the scope of the stated terms of use.

In the event of unauthorized use or use that deviates from the terms of use, we may take appropriate measures, including legal action.

Article 17 (Governing Law and Jurisdiction)

This Agreement shall be governed by and construed in accordance with the laws of Japan. Notwithstanding the foregoing, the United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Service.

In the event of any dispute arising out of or in connection with this Service, the courts of the jurisdiction in which the head office of this shop is located shall have exclusive jurisdiction.

Article 18 (Use of Digital Content)

  1. Digital content marked as “Downloadable” on this shop (including image files, vector files, and other digital formats) may be used by the purchaser for both personal and commercial purposes.
    　The content may be used at a flat rate, regardless of the medium, number of uses, print quantity, or sales volume.

  2. The following terms of use must be observed:
    　(1) The copyright of all materials remains with this shop and is not waived.
    　(2) Download attempts are limited to a maximum of five times, and sharing the download URL or files with third parties is prohibited.
    　(3) Redistribution, resale, or unauthorized reproduction (with or without modification) of the content is strictly prohibited.
    　(4) Modification of the content is permitted, but distribution or sale of modified versions is also prohibited.
    　(5) If the content is used as part of a final creative work by the purchaser, the sale, exhibition, or distribution of the final product is permitted.

  3. In the event of a violation of these terms, the shop reserves the right to take strict action, including suspension of sales, claims for damages, or legal measures.
